Family mediation is a process where a neutral, qualified family law mediator helps family members talk through their issues and reach agreements. This can cover all sorts of things – from sorting out parenting arrangements and finances to dividing property and resolving other family conflicts.

Divorce & Family Mediation FAQs

Why choose mediation?

Family mediation can save you loads of time and money compared to going to court. It lets you stay in control of what happens, rather than leaving it up to a judge. Plus, the solutions you come up with in mediation tend to work better in the long run, which means fewer arguments down the line.

What are the grounds for divorce?

Since April 2022, “no-fault divorce” means the only ground is that the marriage has irretrievably broken down. There’s no need to prove blame or fault, making the process less confrontational for both parties.

How long does a divorce take?

A straightforward divorce takes at least six months. Resolving finances or child arrangements can take longer. Mediation often helps couples reach agreements faster and with less stress.

What is the process for obtaining a divorce?

Apply online (solely or jointly), submit your marriage certificate, and wait 20 weeks before applying for a conditional order. After a further six weeks, you can apply for the final order, which legally ends the marriage.

What is the court fee for filing a divorce application?

The court fee is currently £612 (as of June 2025). This fee is separate from any legal or mediation costs you may have.

What happens if we separate while cohabiting (not married)?

Cohabiting couples do not have the same legal rights as married couples. Financial claims depend on property law or agreements. If you have children, you may claim financial support for them under the Children Act.

Is mediation legally binding?

Mediation agreements aren’t automatically legally binding, but you can apply to court for a consent order to make them enforceable.

Who pays for mediation?

Costs are usually shared, but you can agree otherwise. Legal aid may be available if you qualify.

Do I need a solicitor if I use mediation?

You don’t have to, but legal advice is recommended, especially before making agreements legally binding.

We help you decide on the best parenting arrangements for them that are affordable. We work with you so you can communicate with them about what is going on in your relationship.

    We guide you through a process so that you share information and your perspectives and you can start to understand and build separate financial lives. We work with lawyers and financial advisers where that will help. We work with you to discuss and negotiate an outcome that will stand the test of time.

    Increasingly, family mediation is proving its worth in a range of other family related issues such as: the negotiation of pre-nuptial agreements, co-habitation agreements and the separation of co-habiting couples by offering a flexible and cost effective solution that can be offered to clients in a time critical way.
