I’ve sat through many days of hearings in the Royal Court of Justice. What I’ve noticed is that the second most important place to look after the Judge, is the door at the back. The door through which journalists enter.

When someone comes in through that door, everyone’s working out whether they’re a journalist and what they might make of it.

Contrast that with mediation. The traditional setting is a law firm’s offices with each party’s room at opposite ends of the building, often so far from the natural light of day it’s almost claustrophobic. Impossible for anyone else to get a look in. And entirely up to the parties what they tell the world about the settlement.

Privacy is so important to both private individuals and businesses. Early mediation is an effective way to bring an end to a conflict privately, before it becomes a public case.
